Company: Hyper Hitter Pty Ltd

This Warranty Policy explains the 12-month limited warranty provided for eligible Hyper Hitter physical products purchased directly through our website in the United States and Australia.

It outlines warranty coverage, exclusions, customer responsibilities, available remedies, and the process for submitting a warranty claim.

All warranty benefits are provided in addition to any rights and remedies available under applicable consumer protection laws.

Hyper Hitter Pty Ltd provides a 12-month limited warranty from the date of delivery for eligible Hyper Hitter physical products purchased directly through www.hyperhitter.com in the United States and Australia.

This warranty covers defects in materials, manufacturing, and workmanship that arise during normal, intended use.

Coverage applies to products used in both residential and commercial gym environments, provided the product is installed, operated, and maintained correctly and in accordance with its intended purpose.

Where a defect is covered, Hyper Hitter will assess the circumstances and provide an appropriate remedy in accordance with this policy and applicable law.

The limited warranty covers manufacturing defects and defects in materials or workmanship arising during normal, intended use.

Examples may include:

  1. Manufacturing or assembly defects.
  2. Structural defects resulting from faulty materials or workmanship.
  3. Defective mounting components or hardware.
  4. Components that fail due to a manufacturing defect.
  5. Other defects assessed and confirmed as covered under this warranty.

Coverage is conditional upon the product being installed, operated, and maintained in accordance with applicable instructions.

Normal use includes appropriate residential boxing training and commercial gym training.

A product is not excluded from warranty coverage merely because it has been used in a commercial gym.

This limited warranty does not cover damage or failure caused by:

  1. Normal wear and tear
  2. Misuse or abuse
  3. Accidental damage
  4. Excessive or abnormal impact
  5. Improper installation or mounting
  6. Installation on an unsuitable wall, rack, rig, or mounting surface
  7. Incorrect or incompatible mounting hardware
  8. Failure to follow installation or safety instructions
  9. Neglect or inadequate maintenance
  10. Unauthorized modifications, alterations, or repairs
  11. Improper storage
  12. Commercial or high-frequency use where the resulting damage is outside normal intended use
  13. Use with incompatible equipment or mounting systems
  14. Damage caused by unsafe or incorrect use
  15. Cosmetic damage that does not affect the product's functionality
  16. Exposure to water, excessive moisture, rain, or unsuitable weather conditions

Hyper Hitter products must only be installed on suitable surfaces, racks, or rigs using appropriate hardware and safe installation practices.

Damage resulting from unsuitable mounting surfaces, loose fittings, incorrect hardware, incompatible equipment, improper installation, or exposure to unsuitable environmental conditions is not covered by this limited warranty, except where coverage is required under applicable law.

Nothing in this section excludes or limits any rights or remedies available under applicable consumer protection laws.

Hyper Hitter products may be mounted to compatible racks, rigs, or suitable solid brick or concrete walls using the appropriate mounting system.

Customers are responsible for confirming that their installation environment is suitable before installing and using the product.

Before use, customers should:

  1. Check the product's published compatibility specifications.
  2. Confirm the rack or rig is structurally suitable and properly secured.
  3. Confirm that wall-mounted installations use suitable solid brick or concrete surfaces.
  4. Use the appropriate mounting hardware and follow the supplied instructions.
  5. Ensure all bolts, fittings, brackets, and mounting components are properly secured.
  6. Regularly inspect the product and mounting system for loosening, wear, or damage.
  7. Stop using the product immediately if it becomes loose, damaged, unstable, or unsafe.

Hyper Hitter is not responsible for damage to walls, racks, rigs, flooring, surrounding property, or other equipment caused by incorrect installation, unsuitable mounting surfaces, incompatible equipment, or failure to follow installation instructions, to the extent permitted by applicable law.

Nothing in this section excludes liability that cannot lawfully be excluded.

Hyper Hitter products may be used in residential gyms, commercial gyms, boxing studios, fitness facilities, and other appropriate training environments.

The 12-month limited warranty applies to eligible residential and commercial purchases.

Commercial or high-frequency use may result in increased normal wear and tear, which is not itself a manufacturing defect.

Damage caused by misuse, abnormal impact, inadequate supervision, unsafe installation, poor maintenance, or use outside the product's intended purpose is not covered to the extent permitted by law.

Gym owners and facility operators are responsible for ensuring that the product is installed securely, maintained appropriately, and used safely.

Manufacturing defects arising during normal, intended commercial use remain eligible for warranty assessment.

The limited warranty is valid for 12 months from the date of delivery for eligible purchases made directly through www.hyperhitter.com in the United States and Australia.

The defect must arise during the applicable warranty period to qualify under this voluntary warranty.

Proof of purchase, delivery information, or other reasonable evidence may be requested.

Where a product or component is repaired or replaced under this limited warranty, the replacement or repaired component will generally remain covered for the remainder of the original 12-month warranty period.

A repair or replacement does not automatically restart the voluntary 12-month warranty period.

This does not restrict any additional warranty obligations or statutory rights that may apply, including rights that continue beyond the stated warranty period.

To submit a warranty claim, customers should contact:

Email: info@hyperhitter.com

Please provide the following information:

  1. Full name.
  2. Order number.

  4. Delivery address.
  5. Date of purchase, where available.
  6. A clear description of the issue.
  7. Clear photographs or videos showing the problem.
  8. Photographs of the product from multiple angles, where appropriate.

For issues involving mounting, installation, or compatibility, we may also request:

  1. Photographs of the wall, rack, rig, or mounting setup.
  2. Photographs showing how the Hyper Hitter has been installed.
  3. Rack or rig brand and model, if known.
  4. Upright width and through-hole measurements.
  5. Photographs of the mounting hardware.
  6. Additional information about installation and use.

Hyper Hitter may request further information or evidence reasonably necessary to assess the claim.

Customers should contact us before returning a product so we can provide appropriate instructions and avoid unnecessary shipping costs.

Failure to provide a particular photograph or document will not automatically invalidate rights under applicable consumer protection laws.

Once a claim is received, Hyper Hitter will review the information and evidence provided.

Our assessment may include:

  1. Reviewing photographs or videos.
  2. Confirming purchase and delivery information.
  3. Reviewing the product's installation and operating conditions.
  4. Identifying whether the issue relates to manufacturing, materials, workmanship, installation, or use.
  5. Requesting additional information or inspection where reasonably necessary.

Where appropriate, Hyper Hitter may request that the affected component or product be returned for inspection.

Customers should not attempt unauthorized repairs or modifications that could cause further damage or create safety risks.

Where a defect is confirmed, Hyper Hitter will advise the customer of the appropriate remedy in accordance with this policy and applicable law.

If a claim is not covered by the voluntary warranty, we will explain the assessment outcome and consider any applicable statutory consumer rights.

Claims will be assessed within a reasonable timeframe.

For confirmed manufacturing defects or other failures covered by applicable consumer protection laws, Hyper Hitter will cover or reimburse reasonable return shipping expenses where required by law.

Where a product must be returned for assessment, Hyper Hitter will provide instructions before the customer ships the item.

For Australian customers, reasonable return transport costs will be reimbursed where a product is confirmed to have a failure covered by Australian Consumer Law, in accordance with applicable legal requirements.

Where the law requires collection or transport to be arranged by the supplier, Hyper Hitter will make appropriate arrangements.

Customers seeking reimbursement should retain receipts or other evidence of reasonable shipping expenses.

Where a product is assessed and no defect or applicable failure is identified, reasonable inspection or transport charges may apply only where permitted by law and after any required advance disclosure.

Customers should not send products to a warehouse or third-party logistics provider without first receiving return instructions.

Unauthorized returns may experience delays while the shipment is identified and assessed.

If a product is confirmed to have a defect covered by this warranty, Hyper Hitter will provide an appropriate remedy.

Available remedies may include:

  1. Supplying replacement components or hardware.
  2. Repairing the affected component or product.
  3. Replacing the defective product.
  4. Providing a refund where appropriate or legally required.
  5. Providing another remedy agreed with the customer and permitted by applicable law.

Where appropriate, Hyper Hitter may offer replacement parts or repairs before replacing the entire product.

This approach allows issues involving individual components to be resolved without unnecessarily replacing a complete unit.

However, the remedy will depend on the nature and severity of the issue and applicable consumer protection laws.

For Australian customers, a major failure may entitle the customer to choose between a refund and replacement. For a non-major failure, Hyper Hitter may provide an appropriate repair within a reasonable time, subject to the customer's statutory rights.

Store credit may be offered where appropriate but will not replace a refund or other remedy to which a customer is legally entitled without their agreement.

Replacement components or products may be new or refurbished where permitted by law and appropriate to the remedy.

If an identical replacement is unavailable, Hyper Hitter will discuss an appropriate alternative consistent with applicable law.

This limited warranty provides additional benefits and does not replace, restrict, or exclude mandatory consumer guarantees or statutory rights.

Australia — Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights may continue beyond the 12-month voluntary warranty period.

United States

United States customers may have additional rights under applicable federal and state consumer protection and warranty laws.

Nothing in this policy excludes or limits rights or remedies that cannot lawfully be excluded or limited.

Warranty claims are separate from voluntary change-of-mind returns.

Hyper Hitter's Refund & Returns Policy provides details regarding:

  1. The 14-day return period for eligible unused products.
  2. Change-of-mind returns.
  3. Products purchased for incompatible racks, rigs, or mounting surfaces.
  4. Customer-paid return shipping for approved voluntary returns.
  5. Pre-order cancellations.
  6. Refund processing.
  7. Complimentary promotional items, including Black Friday boxing gloves.

A product that is incompatible with a customer's existing equipment does not automatically qualify as defective.

However, eligible unused products may be returned within the applicable 14-day return period in accordance with the Refund & Returns Policy.

Where a product is incorrectly described, defective, or otherwise fails to meet applicable consumer guarantees, statutory rights continue to apply regardless of the voluntary return conditions.
